By accessing or using the Maa Bawe India Pvt Ltd website (https://akhilconstruction.com), mobile applications, or any related services (collectively, the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional guidelines or policies posted on the Platform.

We reserve the right to modify these Terms at any time. Changes will be effective upon posting. Your continued use of the Platform after any changes constitutes acceptance of the revised Terms. We will notify registered users of material changes via email or in-platform notification.

To use the Platform, you must:

• Be at least 18 years of age.
• Be a resident of India or operate a business registered in India.
• Have the legal capacity to enter into a binding contract.
• Not be barred from using similar services under applicable Indian laws.
• Not have a previously terminated account on our Platform without our prior written consent.

By using the Platform, you represent and warrant that you meet all of the above eligibility requirements. We reserve the right to refuse service to anyone for any reason at any time.

To access most features of the Platform, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information.
• Keep your password secure and confidential. Do not share your password with third parties.
• Notify us immediately at info@akhilconstruction.com of any unauthorised use of your account.
• Be responsible for all activities that occur under your account.

We reserve the right to suspend or terminate accounts with inaccurate, fraudulent, or incomplete information. One account per individual or business is permitted unless explicitly authorised by us.

As a homeowner or client using the Platform to find construction professionals, you agree to the following:

4.1 Project Postings

• Projects must be genuine, legal, and clearly described. Misleading or fraudulent project postings are prohibited.
• You must have the legal authority to commission the work described in your project (e.g., ownership or authorisation from the property owner).
• Budget and timeline information must be realistic and provided in good faith.

4.2 Engaging Professionals

• You are solely responsible for evaluating bids, reviewing professional credentials, and selecting a contractor.
• While we verify professionals to the best of our ability, we do not guarantee the quality, timeliness, or legality of work performed.
• Payments must be made through the Platform's escrow or payment system to be eligible for dispute resolution support.

4.3 Prohibited Conduct

• Do not attempt to transact with professionals outside the Platform to circumvent fees.
• Do not post fake projects to collect bids for research or competitive intelligence purposes.
• Do not submit false or vindictive reviews against professionals.

As a contractor, architect, engineer, or service provider ("Professional") using the Platform to find work, you agree to:

5.1 Representation & Accuracy

• Provide truthful and accurate information about your qualifications, experience, certifications, and business registration.
• Upload only genuine document proofs for verification.
• Represent only yourself, your team, or your registered business — not third parties without authorisation.

5.2 Bidding & Work Delivery

• Submit bids only for projects you intend to complete professionally and on time.
• Honour the bid amount and timeline stated in your accepted proposal.
• Obtain any required government permits or licences necessary for the work.
• Deliver work that meets industry quality standards and the client's agreed specifications.

5.3 Prohibited Conduct

• Do not solicit clients to transact outside the Platform during an active project.
• Do not create multiple accounts or manipulate your rating/review score.
• Do not misrepresent your professional credentials, insurance, or past projects.
• Do not subcontract platform projects without client consent.

All users of the Platform — regardless of role — must adhere to the following rules:

• Honesty: Do not misrepresent yourself, your projects, or your work.
• Respect: Treat all users with dignity. Harassment, intimidation, and discrimination of any kind are prohibited.
• Legal Compliance: Do not use the Platform for any illegal purpose, including money laundering, tax evasion, or unlawful construction activity.
• No Spam: Do not send unsolicited commercial messages or engage in platform manipulation.
• Authenticity: Do not create fake accounts, post fake reviews, or manipulate the ranking system.
• Security: Do not attempt to hack, probe, or disrupt platform infrastructure or other user accounts.
• Intellectual Property: Do not upload content that infringes another party's copyright, trademark, or trade secret.

Violations may result in content removal, account suspension, legal action, or permanent banning from the Platform.

7.1 Bids

Bids submitted by Professionals constitute formal proposals. Acceptance of a bid by a Homeowner creates a binding agreement between those two parties, not with . We are a technology intermediary facilitating the transaction.

7.2 Contracts

Digital contracts generated through the Platform outline scope of work, milestones, payment schedule, and timelines. Both parties must sign digitally before work commences. Oral agreements made outside the Platform are not recognised for dispute resolution purposes.

7.3 Payments & Escrow

• Milestone payments released by the Homeowner are held in escrow until milestone completion is confirmed.
• Professionals receive payment only after the Homeowner approves a completed milestone.
• In case of dispute, funds remain in escrow until resolution.
• All transactions are subject to applicable GST and TDS under Indian tax law.

Off-platform transactions: We strongly advise against transacting outside the Platform. Off-platform payments are not eligible for our dispute resolution or buyer protection services.

8.1 Homeowner Fees

Posting projects on the Platform is free of charge for homeowners and clients.

8.2 Professional Subscription Fees

Professionals may choose a subscription plan (Essential, Growth Pro, Business Plus) as detailed on our Pricing Page. Monthly subscription fees are charged in advance and are non-refundable.

8.3 Platform Commission

A platform commission of 10% (plus applicable GST) is deducted from each milestone payment released to a Professional. This fee is transparently shown before any transaction is confirmed.

8.4 Fee Changes

We reserve the right to change our fee structure with 30 days' prior notice. Continued use of the Platform after the change constitutes acceptance of the new fees.

We maintain a rigorous verification process for Professionals to build trust on the Platform:

• Identity verification via government-issued ID (Aadhaar, PAN, Passport).
• Business registration document verification (Certificate of Incorporation, GST Certificate).
• Professional licence verification (applicable for architects, engineers, electricians).
• Periodic review of ratings and project completion records.

Important: Our "Verified" badge indicates that documents submitted by a Professional have been reviewed and appear authentic at the time of verification. It does not constitute an endorsement of the quality of their work, nor does it guarantee any specific outcome. Homeowners remain responsible for conducting their own due diligence.

10.1 Our Platform

The Platform, including its design, layout, logo, trademarks, and software, is the exclusive property of and is protected under Indian and international intellectual property laws. You may not copy, reproduce, modify, or distribute any part of the Platform without our express written consent.

10.2 Your Content

By submitting content to the Platform (project descriptions, images, reviews, portfolio items), you grant us a non-exclusive, royalty-free, worldwide licence to host, display, and use that content to operate and promote the Platform. You retain ownership of your content.

10.3 Infringement

If you believe content on the Platform infringes your intellectual property rights, please submit a takedown notice to info@akhilconstruction.com with details of the alleged infringement.

11.1 Platform as Intermediary

is an online marketplace and technology intermediary as defined under the Information Technology Act, 2000. We are not a party to any contract between Homeowners and Professionals. We do not employ Professionals, supervise construction work, or guarantee work quality or outcomes.

11.2 Disclaimer of Warranties

The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

11.3 Limitation of Liability

To the maximum extent permitted by law, shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, data, or business opportunities.
• Defective workmanship or project outcomes by Professionals.
• Actions or omissions of third-party service providers.
• Losses resulting from off-platform transactions.

Our maximum aggregate liability for any claim arising from your use of the Platform shall not exceed the total platform fees paid by you in the 12 months preceding the claim.

12.1 Between Users

Disputes between Homeowners and Professionals should first be attempted to be resolved between the parties. If unsuccessful, either party may escalate to our Dispute Resolution Team by filing a complaint via the Platform.

12.2 Our Role

We may, at our sole discretion, review project records, communications, and milestone documentation to facilitate resolution. Our decision in such matters is advisory unless both parties have agreed otherwise in writing.

12.3 Arbitration

Any dispute between you and that cannot be resolved informally shall be subject to binding arbitration under the Arbitration and Conciliation Act, 1996, before a single arbitrator mutually agreed upon by the parties. The seat of arbitration shall be Bengaluru, Karnataka, India.

12.4 Class Action Waiver

You agree to bring disputes against us only in your individual capacity and not as a plaintiff or class member in any purported class action.

13.1 By You

You may deactivate your account at any time from your account settings. Account deletion requests are processed within 30 days, subject to any outstanding disputes or pending transactions.

13.2 By Us

We may suspend or permanently terminate your account, with or without notice, if:

• You violate these Terms or our policies.
• Your conduct creates legal risk for us or other users.
• We are required to do so by law.
• You engage in repeated disputes or fraudulent behaviour.

13.3 Effect of Termination

Upon termination, your right to use the Platform immediately ceases. Sections relating to IP, liability, dispute resolution, and governing law shall survive termination.

These Terms and any disputes arising from or related to the Platform shall be governed by and construed in accordance with the laws of the Republic of India, including but not limited to:

• The Indian Contract Act, 1872
• The Information Technology Act, 2000 and Amendment Act, 2008
• The Consumer Protection Act, 2019
• The Arbitration and Conciliation Act, 1996

Subject to the arbitration clause, the courts of Bengaluru, Karnataka, shall have exclusive jurisdiction over any legal proceeding arising out of these Terms.
